DOL Extends Deadline for Foreign Worker Job Input

DOL Extends Deadline for Foreign Worker Job Input

The U.S. Department of Labor (DOL) has paused its plans to expand the list of occupations eligible for employment-based green cards. Originally set for February 20th, the deadline for public comments has been extended to May 13th, 2024. This news gives stakeholders more time to consider and provide feedback on the proposed changes.

Why does this matter?

The “Schedule A” list identifies occupations considered exempt from the labor certification process for obtaining an employment-based green card. This means employers can sponsor foreign workers for green cards without first demonstrating that they cannot find qualified U.S. workers.

Expanding the list could help address worker shortages in certain industries, such as STEM.

What are they asking for?

The DOL is seeking public input on a variety of questions, including:

  • Should the agency revise the “Schedule A” list at all?
  • What data sources and methods should be used to determine whether labor shortages exist?
  • How the DOL could identify STEM occupations experiencing labor shortages.
  • How to ensure a reliable, objective, and transparent list update process.

What does this mean for you?

If you have an opinion on the proposed changes to Schedule A, now is your chance to make your voice heard! The DOL welcomes input from a wide range of stakeholders, including:

  • Businesses and employers
  • Workers and labor unions
  • Educational institutions
  • Advocacy groups
