If you are a foreign national who wants to do business in the United States, here are a few things you should know.
The different types of business visas in the US
Many people immigrate to the US on a business visa, which allows them to remain in the US for various business purposes. You may qualify for various types of USA business visas depending on your situation.
If you want to do business in the US, you can qualify for a business visa by demonstrating to the US government that you have valuable skills and talent that are essential to your business and that you are a valuable asset to this country. Here are the most common types of USA business visas.
1. The B-1 visa.
A B-1 visa is a short-term visa that allows you to enter the United States on business-related grounds. It is issued to individuals who need to go to the United States for work purposes, such as attending a conference, a business meeting, or entering into a contract.
B-1 visas are for business purposes only and do not allow individuals to take on a full-time job in the United States. However, in March 2023, it was announced that individuals with a B-1 visa could begin applying for jobs and attending interviews in the United States.
If you want to work in the United States, you may want to consider applying for a B-1 visa. B-1 visas are less restrictive than other types of visas, but you still must meet certain criteria. To qualify for a visa, you must:
- Visit the United States for a business purpose;
- Have sufficient funds to support yourself during your stay in the United States;
- Have the willingness to leave the United States upon expiry of your visa;
If you are interested in exploring this possibility, contact an immigration lawyer.
2. The E-1 USA business visa.
The E-1 visa is designed for individuals with special skills, innovative professors, researchers, or multinational business managers or executives. This type of USA business visa allows individuals to enter the United States to engage in some trade independently.
In some cases, employees can also hold this type of USA business visa. Applicants must be able to engage in at least 50 percent of their trade between their country and the United States. If an individual is a business person from a particular treaty country, they can obtain an E-1 visa to do business in the United States.
This visa enables them to engage in many transactions with companies in the United States and their country of origin. E-1 visa holders can do business in various industries, such as transportation, communications, banking, advertising, and management.
Most E-1 visas are valid for 5 years. USCIS allows you to extend your E-1 status for up to 2 more years. There are no limits on how many E-1 status extensions you can get. This means you can stay in the US indefinitely. If you have a spouse or children under the age of 21 who want to stay with you for the remainder of your E-1 visa stay, you may be able to.
Your spouse can work during their E-1 stay in the United States by filing an employment authorization document (EAD). If you believe this might be your best option, hire an immigration lawyer.
3. The E-2 USA business visa.
To be eligible for this visa, you must have made a substantial investment in a US company, owned more than 50% of that company, or be in a management role while in the country to manage that business company. You must also meet the specific requirements.
You must have worked for the company for at least one year and meet the requirements of your job description, which must be executive/supervisory. Each qualifying business must produce a profit or loss.
E-2 visa holders are only eligible for this visa if they have done substantial business in an active “bona fide” enterprise that has the current and future capability to financially support them and their families.
E-2 visas are valid for up to two years and can be renewed indefinitely. E-2 visa business owners and their employees are allowed only to do business in the area they applied for. If the business owner’s scope changes, they must have the USCIS confirm it.
If you think you qualify for this option, contact an immigration lawyer to help you.
4. The EB-5 USA business visa.
The first EB-5 visa was issued in 1990. It aimed to increase employment and attract foreign capital to the United States. The EB-5 visa is a green card-level visa issued by the US Citizenship and Immigration Services to qualified business owners.
EB-5 business owners can also obtain green cards for their spouses and unmarried children under 21. However, business owners must meet certain criteria to qualify for this visa. Depending on the type of EB-5 visa you have, you may not need to manage your own business.
Sometimes referred to as the “golden visa,” this visa allows people to enter the United States if they demonstrate an investment of up to $1.5 million. The minimum investment for this visa ranges from $800,000 to $1.05 million.
However, you may be eligible for an investment visa if you invest $500,000 or more in a rural employment area or a sector with high unemployment rates. You may also be eligible for an EB-5 business visa if you invest cash, equipment, stock, or other physical assets.
Remember that EB-5 investments are valued at fair market value (US dollars), and borrowed monies cannot be used. The US government must review the EB-5 visa because of its long history of fraud and abuse. If you are a foreigner who wants to explore this possibility, contact an immigration lawyer who can help you with your application.
You will need business plans, an economic analysis, and evidence that you own the funds you use for your business.
The processing time of the USA business visas
The processing time varies depending on several factors, such as how complex your case is and how many visa applications are processed by your service center. The processing time also depends on whether you qualify for the visa and how comprehensive your documents are.
The average processing time ranges from 20.5 to 27 months, depending on the USA business visa you are applying for. You can also speed up the process using a premium processing service, which is available for an additional fee. You can find out more about it by talking to an immigration lawyer.
