Do you want to work as a religious worker in the United States? If so, applying for an R-1 visa in the USA is the best option. An R-1 visa is a temporary work visa for non-immigrants. It is intended for foreign nationals who want to work as religious workers in the United States.
The R1 visa is a nonimmigrant visa for religious workers. It allows religious workers to work for qualified nonprofit religious organizations or churches for up to 5 years. It is a temporary visa program for qualified religious workers to work and live in the United States for a period.
The R-1 visa in the USA is a visa program for religious workers offered by the United States government. It is designed to allow individuals to immigrate to the United States to pursue their religious calling, profession, or ministry. Each category has its own set of requirements that must be met.
For instance, a person pursuing a religious calling may be a nun, a monk, or someone who has taken a lifelong vow. A person pursuing a religious profession must perform religious duties that relate to traditional religious functions and are essential to the faith.
If someone is entering the United States to become a minister, they must be a certified member of the clergy, a licensed minister, and a trained minister. A religious organization must be a bona fide group. Our office will help you determine if your organization meets this requirement.
This guide will provide all the information you need about this visa.
The meaning of the R-1 visa
R-1 visas in the USA are temporary work visas issued to foreign nationals who enter the United States to work as religious workers for up to 30 months or 2.5 years. After 30 months, an R-1 visa holder can apply for an additional 30-month extension of stay for a maximum of 5 years.
R-1 visa holders must work for a qualifying religious non-profit or church for at least 20 hours per week, and a certain set of criteria must be met. Not all religious workers qualify for this type of visa. For instance, non-members of a religious organization, such as secular members, are not eligible for R-1 visas in the USA.
The benefits of R-1 visas
This type of visa allows R-1 visa holders to obtain a driver’s license, open a bank account, and enroll in full or part-time religious studies. They are also allowed to travel outside the US, and the amount of time they spend abroad is not included in their total visa period.
Some workers will also work part-time in the United States in religious positions. These workers are not barred from working in the United States and can work in other countries while traveling to the United States for various periods to perform their work duties.
Getting an R-1 visa in the USA means that you do not have to stay in the United States for the entire duration of your visa, but you can also work in other countries. There are no limits on how many R-1 visas can be issued. Anyone who meets the requirements can apply for this visa and work in their chosen field.
An R1 visa in the USA allows a spouse and children to enter the United States under the status of R-2. The spouse and children cannot work in the US. The purpose of the R-2 visa is to accompany the spouse and children of an R1 visa holder.
The R-1 visa in the USA is a visa with a dual purpose. If you apply for the R-1 visa, you can also apply for green card status. This means that R-1 visas in the USA can be used to obtain permanent residency. The usual ways to obtain R-1 permanent residency are through marriage, family reunification, or by changing your immigration status.
However, other ways exist to apply for an R-1 green card, including EB-4 green cards that allow religious workers to obtain permanent residency in the US.
Who is eligible?
There are a number of requirements for R-1 visa applicants who wish to work as religious workers. This is because there are many different types of religions in the world, and not everyone can be established in the United States. As a result, there are requirements for both the applicant and the organization that hires them.
Applicants must meet the following criteria to be eligible for R-1 visas in the USA:
- Be part of a religious organization in the past two years.
- The religion must have a non-profit organization in the US.
- Be employed within the non-profit organization.
- Be a minister or a direct staff of a non-profit religious organization.
- Be ready to work part-time for at least 20 hours per week.
- Must not be employed in a different job than their religious profession.
An R-1 visa in the USA is issued to someone sponsored by organizations that meet the following requirements:
- Are based in the US.
- Are affiliated with a religious organization.
- Are tax-exempt holders.
- Are non-profit organizations in the United States.
If your hiring organization meets these criteria, you can begin your R-1 visa application. However, due to the many religions worldwide, the US government has clarified what a religion is and the R-1 visa criteria. A religious community is a group of people who worship the same god and follow the rules of the religious authority. They:
- Share the same beliefs
- Participate in the same rituals, services, and ceremonies.
- Have the same code of discipline.
- Have religious organizations.
- Share the same place of worship.
The application process
You and your sponsor must take a few steps to apply for the R-1 visa in the USA. First, you can’t begin the application without your sponsor’s permission. The sponsor can do this by petitioning USCIS to authorize the employee (the applicant) to work within the US. A brief break-down of the application process is as follows:
1. File petition.
The religious sponsor files the foreign national workers’ form I-129. The religious sponsor pays the fees and provides the necessary documentation for the forms. Religious sponsors should consult with an experienced immigration lawyer.
A copy of the completed forms must be provided. A signature must be provided on the form. A site visit will be announced and scheduled by USCIS. The USCIS will visit your religious organization’s premises.
The fraud officer will check that your organization exists, complies with the required requirements, and that the information provided is accurate. The official from USCIS will likely want to talk to the representative of your organization, particularly the employer that signed off on your petition. If all goes as planned, the petition will be approved through form I-797.
2. The form DS-160 filing.
Once I-129 is approved, the worker can begin the end of the visa application process by filling out Form DS-160 at their home country’s consulate or embassy. They will need to pay fees and submit the necessary documents.
During the DS-160 application process, the worker will be asked about their personal details, background, and purpose in the United States. After filling out the DS-160 form, the worker has to save the confirm page and code in their documentation file.
3. The interview.
All applicants between 14 and 79 seeking a nonimmigrant visa must schedule an interview with a visa officer at the US embassy. To fulfill this obligation, you will need to schedule your interview.
Due to the high workload of the US embassy you are applying to, scheduling your interview as soon as possible is advisable to avoid long waiting times. Once you have scheduled your interview, you will receive a visa interview confirmation letter, which you will need to take to your interview.
Prepare the documents you need to support your application. Be sure to bring all the necessary paperwork and arrive at your interview on time. Your interviewer will ask about your past and future plans and why you are coming to the United States.
You will need to provide as much information as possible to persuade them that you have a job and income in the United States.
The processing time
The approval process for the R-1 visa in the USA takes time. After the sponsor submits the petition, USCIS may take 6 months to respond. This is because USCIS may need to visit the organization’s premises.
If USCIS has visited your organization before and approved it, you can request premium processing to speed up things at an additional fee. With premium processing, you will receive a response to your application in approximately 2 weeks.
If you don’t have premium processing, once USCIS approves your petition, it may take an additional 2 to 3 months to process your visa. The entire R-1 visa processing time could be 8 to 9 months without premium processing.
