USCIS Extends Temporary Suspension of Biometrics Submission for Specific Form I-539 Applicants.

The U.S. Citizenship and Immigration Services (USCIS) has suspended the biometrics requirement for H-4, L-2, and E derivative status changes and extensions in the United States until September 30, 2023.

This means that applicants filing Form I-539 for H-4, L-2, or E-1, E-2, or E-3 derivative status will not be required to attend a USCIS (USCIS Extends Temporary Suspension)  biometrics appointment for fingerprint and photo capture during this. However, USCIS retains the authority to request biometrics on a case-by-case basis if necessary.

Furthermore, USCIS (USCIS Extends Temporary Suspension) has confirmed its intention to eliminate the biometrics requirement for all Form I-539 applicants permanently. The agency plans to establish this permanent exemption in the coming months, as previously announced in the USCIS Fiscal Year 2022 Progress Report, released in December 2022.
